Terms and Conditions
PAYMENTS
For all accounts, a 50% deposit is required for all jobs. The remaining
balance for any job is due at completion and time of delivery.
Once work has begun, the deposit is non-refundable.
If additional charges have been incurred, you will be notified in
advance of your final invoice for payment.
Accepted payments are cash, check and credit card*
via PayPal.
All credit card payments are required to sign and
actively defend our no-refund policy agreement on any intellectual
conceptions, materials, products, properties, services and any
transactions provided by Gerald Lickman.
A forty-five day time period will be allotted to
complete projects, if not otherwise agreed upon in the contract. If a
significant amount of the project has been completed after forty-five
days, which will be determined by Gerald Lickman, You will be billed 50%
of the total remaining balance.
TURNAROUND
Typically, the process for design takes about 7-10 days for the first
round of concepts. If appropriate, a questionnaire will be emailed to
you to fill out and return which will help us identify your needs. The
timeframe shall be extended if there is a delay is response time, and
will be based upon receipt of your completed questionnaire and approval
of the contract. Revisions thereafter have a 72 hour turnaround time.
Rush projects and weekend work will be charged an
additional 25% on top of our standard rate.
DELIVERY
All projects will be emailed to you as low resolution PDF or JPG file.
Final designs will be emailed as a high resolution print-ready PDF, EPS
or JPG file. If you require additional formats, please let us know and
will accommodate you as best we can.
If files are too large to be sent via email a CD will
be mailed to you. After final payment has been received a zip file will
be emailed to You. A CD of final artwork can be mailed upon request.
PRINTING
Pricing is for design only. If the client is in need of print services,
we offer quotes for printing at no charge.
If the client requires Gerald Lickman to set up an
account with a printer and upload all files, a $75 set-up fee will be
charged.
ERRORS
& OMMISIONS
It is your responsibility to check proofs
carefully for accuracy in all respects, ranging from spelling to
technical illustrations. Gerald Lickman is not liable for errors or
omissions. By the time your job gets in our hands and we are ready to go
to print all design issues should be settled.
Your approval is required to release the project for
printing. Under no circumstances will a refund or reprint be honored for
an error in the file submitted or the design that was approved.
SUB-CONTRACTING
Gerald Lickman shall have the right to assign any portion of the work
required to a contractor if needed.
COPYRIGHT & TRADEMARK
All design, layouts and any media elements and / or projects are
exclusive and specific for one time use publishing only as a whole
compilation and it is prohibited to reverse engineer any part or any
media element for any purpose other than originally intended. All
work-up and media elements in any project designed by Gerald Lickman
remain the intellectual property of Gerald Lickman. All design, layout,
media elements and any formats of designs provided shall remain the
intellectual property of Gerald Lickman, the owner. Rights to clipart,
photos, graphics, source code, work-up files and computer programs that
are not specifically requested, negotiated and purchased under work for
hire are not transferred to the client, and remain the property of their
respective owners.
If you would like to secure, own and
copyright
any design, layout or any media element would
constitute a work for hire project contract and you must negotiate,
purchase and hold in your possession a written contractual release for
any such work for hire design, layout or any media elements directly
from Gerald Lickman for a fee.
Gerald Lickman reserves the right to use any graphic
content developed by Gerald Lickman regardless of ownership, for display
and self-promotional purposes.
